COMPLIANCE

At December’s Director’s meeting our general manager stated the pool facility was in compliance with the Virginia Graeme Baker Pool and Spa Safety Act. The deadline to comply with this year old Federal act designed to lower the needless drowning deaths of children was December 19, 2008.
Our GM said our pools and hot tubs were in compliance.
Under current law, the maximum penalty for one or more related violations is $1.825 million. Congress is considering legislation that would increase this penalty to $10 million plus.
Our GM said our pools and hot tubs were in compliance.
By December 20, 2008, all pools, whether it has single or multiple drains, needs new anti-entrapment drain covers that must comply with ASME/ANSI A112.19.8 performance standard. Your public pool or spa that has a single drain must have at least one additional level of entrapment protection.
Our GM said our pools and hot tubs were in compliance.
Are they really?
The above photographs taken on December 30, 2008 would beg to differ that anything is in compliance. Shown are what appears to be the same Hayward Circular 8”x8” drain covers our pool facility has had for years, including the broken cover in our indoor pool that is not in compliance to even the current Texas codes. Apparently no additional anti-entrapment devices have been installed either.
Is this yet another reason as to why our Board has tried so diligently to make our GM more accountable? Should not Aramark be made aware of such events so as to help towards this GM’s accountability? How much longer is our Village to tolerate not being given accurate information?
Something needs to be done before our facility becomes a statistic along with hundreds of others in having a child drown from entrapment. Let’s help to save a child’s life.
A concerned Villager has graciously provided several websites about this important Federal Law.

The list of wrongful deeds and inaction by this GM just goes on and on. In the last 3 years the BOD has been supplied with documents, pictures and facts from concerned villagers that have proven the incompetence of this management team and nothing has been done!

What will it take?

Once again the GM has shown that he does not know fact from fiction. He just says whatever he thinks sounds good. Frankly, to him it does not matter if it is accurate or the truth or not.

My wish for 2009 is for the GM to leave on 1-1-2009.

I dont know what it will take.. BUT WHAT IN A FLYING NUN DO YOU WANT TO DO???????????????????????
You just make a lot of noise HES
(GM) IS NOT GOING ANTWHERE! The BOD are getting sued.. WE TRIED TO GET RID OF THE GM...THE BOD BLEW IT! You sound like a broken record!
Get rid of the GM get rid of the GM.. Hes not leaving so get used to it! Or move like I'm doing!

Thanks for checking this out. I had doubted that LIV was in compliance with these regs, especially the requirement for additional entrapment protection systems for pools and spas that have only one drain.

This would be worse than incompetence - it's negligence!

Public pools must close unless drains meet new safety rules

Compliance is going to be difficult right off the bat

Enforcement will also likely be a problem. Technically, the CPSC has the enforcement power but it says it hopes local health departments will help,
and of course we hope the GM will help...
then we hope this BLOG will help...
and all the while the drain is still not in compliance.

Can you see a pattern here.. around and around and around..

Why doesn't someone take the initiative buy a drain cover,If you can find them..

and of course our GM has them on order..
only because the covers are on back order!

Bill the park and install the covers?
OH YOU SAY ITS NOT YOUR RESPONDSABILITY!

OH ONE MORE ADDED NOTE AND WHO"S negligence?????

There's more than to just buying drain covers. If I read this info right you also have to add an additional anti entrapment device to each pool and hot tub.

Oh, PLEASE!

It doesn't take a lot of smarts to figure out that the concern of this blog is not to protect children from drowning.

If we're not in compliance, we're not in compliance, but don't make second-guessing our GM's every word and move seem like an "angelic" thing.

Maybe you finally have something on him here. If so, file a complaint--turn him in--but please, don't make it sound like your only concern is a child's safety when you don't even want children in the pool to START with!

RE: gag me!

You are so right! What happened to the pool monitors?

The gm will have some excuse why the covers are not on! Thats the only thing he could say!

Anonymous said...

RE:You are so right!

You are so wrong. You forget our GM said the pools and spas were in compliance, not waiting for anything or being looked into. The only excuse he can say is that He lied ( won't happen)or I didn't know what I was talking about (won't happen). The drain covers are just one thing neccessary. A anti-entrapment device has to be installed also.

RE: GAG me
Dear “GAG ME”, I agree there’s nothing beatific in what the GM ever says. You say this Blog doesn’t care about the safety of the children in this park or doesn’t want kids in the pool. I know the person who writes in this blog and can tell you you’re dead wrong, but it’s obvious that you like to make innuendoes like the SGG. Tell me, other then going outside our Village, who do you file this complaint to? The general manager who’s at fault? The managers he oversees? The non performing Board President who is the only one who can talk to management since the lawsuit against the board? You made light that there’s finally something you have on the GM? Try again. Adding another one of the many things on him would be more accurate. No, I think letting the owners know this to add to how our GM has misled our Village is the only course left.

I just came from using the pool facility. The outdoor hot tub was not hot and the water was a little green. I thought we were paying this $1000 a month to Berry pools to keep this from happening. Doesn't management oversee this?

Sheese "gag me" Why in the world would you think the people of LIV don't care about the safety of children. It would be safe to say our GM doesn't care about the safety of children. It would also be safe to say our GM doesn't care if the village has to pay a big fine.Just like he doesn't care if our village is protected by functioning fire hydrants or secure bank accounts, or trained security officers or clean swimming pools, or well maintained common areas. I really want to know why his supporters, including three BOD members, think this is OK? NONE of this is OK! Why do they think it's OK that he lies to us? They know he lies. We the people have caught him in lies, time after time. This is NOT OK.

Anonymous said...

now! did you hear the gm say that the pools where all set? Is it on record? did you examine the tapes.
I think not. If you listened, he said he ordered them and they are on back order!

Anonymous said...

I taped the whole meeting. Mary taped the meeting. I'm sure the Blog master did too. It is absolutely clear on my tape that he said they were all in compliance. He never once brought up anything as far as any back order. Good try, you're just making that up like our GM probably will try to do.

EXACTLY!

HAPPY NEW YEAR!

I would like to start the New Year off on a positive note by listing all of the GOOD things that Larry has done for LIV.

Still thinking...

Umm, still thinking...

Well, can't think of a thing - anyway, it was worth a try.

He said he was going to spend our money in his speech to all.
NOW I think he's just a very beat up man! And it sad! :(

We are ungrateful at times
Who would really want to do anything for us?

I am not saying hes a good manager!
He really needs to retire and exscape this battering.

Clarifications from "gag me"

#1--I did not say that the author of this blog didn't care about children. I simply pointed out that the people replying to his posts were using it as a ploy to make their personal vendetta with the GM seem "angelic".

#2--I CERTAINLY didn't mean for you to file a complaint with the GM regarding something that the GM didn't do. File it with the state or whoever you want to in order to get this violation enforced. You want rid of Larry--here's your oppurtunity.

The GM is far from perfect. HOWEVER, he's the best one we've had here in FOREVER, and he's CERTAINLY doing a better job than any one of the "fab five (gag me)" could ever think about doing.

Keep on slammin' him, though, and then turn around and say that RP, LM, and PB are the ones that are causing all the grief in the village. Only the close group of friends on this blog agree with you and maybe a handful of people who aren't actually present in the village and read this trash and believe all of it.

Thank You, Joey, for finally allowing some voices with different opinions get through. And REMEMBER that there are far MORE with different opinions who think this is so much of a joke that it's not worth their time, so you don't hear or see their perspective on this blog.

RE: 'clarifications'
I know you would be surprised at how many people DO agree with the opinions voiced in this blog.
You say that RP, LM, and PB are not the ones causing all the grief in the village. WHERE HAVE YOU BEEN?
It is NOT the new directors causing the problems, they DID NOT file a lawsuit. They are trying to GET THINGS DONE RIGHT!!!

RE:Clarifications from "gag me"

This is my first time to comment, I couldn't sit and say nothing any longer.
1. No one was making out the GM to be anything other than again not telling the truth.
2. Why should any owner have to go outside this park to have our GM tell the truth and do his job. Get real! I still don’t understand why you embrace an employee who misleads the people he works for.
You agree you can’t hire a PERFECT person, but a TRUTHFUL one would be nice. Being the BEST GM this Park has ever had only shows just how BAD Aramark provides managers.
No one is SLAMMING anyone. When someone tells you one thing and it’s another, you might let it slide. But when it happens over and over, it’s time to say something about it. Anyone with half a brain who saw what really happened here this summer and fall would tell you RP, LM, and PB had much to do with the situation we currently have that has cost our park far more than grief. Nice try in putting a spin on this but the truth is hard to swallow so don’t gag on it “gag me”.

I was here all summer, all fall, last winter, and the summer before that, as WELL as the fall before that. I doubt if anyone on here has spent more time here than I have over the course of the last four years, and then some.

I have seen all the things our GM has done to improve this village. I have seen him do some things that I thought were stupid. I've seen him being LAZY. But, overall, I've seen the village improve more than it ever did before he came.

There are people with differing opinions and there always will be. However, the true majority of folks are sick of the bickering that has taken place since this new board was elected with the agenda to get rid of our GM. You know it, too, and that's why it bothered you so bad that you had to reply.

Come on, March!

As of 8 a.m. Friday, 1/2/09 the one drain cover that has been loose in the Outdoor Hot Tub all summer long was completely gone, only remnants of 2 edges where the screws were to hold it down remained. One resident was seen to have lost balance in the hot tub when stepping into this "hole"! Wonderful! Congrats to the "GM", whatever the title stands for, but the term Management does NOT come to mind.

I have been here too and you are right....things are getting better...but no thanks to the GM. What I saw prior to the new BOD was dead grass, dead trees, lots of weeds & burrs,& deplorable conditions in many of the common areas. Again you are right...he has made many "stupid" decisions with our money and he is lazy.

There's not a soul on this planet that can keep the grass green when it doesn't rain. Our sprinkler system and budget won't allow it.

I see where the outdoor pool is being closed for liner replacement. Finally!
