MINORITY + LAWSUIT = MAJORITY
9/26/08 Today six Directors of our Board have been sued by Director Leroy Mulch and Reta Priest. Details are sketchy, but it’s known that these three, Directors Hansen, Peterson, and McBride have been sued and served restraining orders until this matter is brought to court. Also sued were Directors Dodson, Young, and President Sullivan. What has our Village become? It appears that Long Island Village may not be “the place to be.”

Welcome Villagers
The monitoring of the 2010 Board will continue. There were again some discrepancies from last year and at the start of this year by the Board President. I am happy to say there is positive change with our new management.
This blog more than ever will try to further the transparency of all issues and reveal any half truths. If you are a concerned owner, either past or present, feel free to comment.

With so many activities at LIV and in the surrounding area, you would think these people could find better things to do with their 'retirement' time than cause constant turmoil and sue people. Kind of reminds me of the lady that sued MCD's when she spilled her hot coffee on her lap.
This is taking sour grapes to a whole new level and I hope it gets straightened out quickly so as not to deplete all the owner's hard earned common fund.
It is sad...really really sad that you all are living through this crap.
I have been an owner in LIV since the 1970's & thought I had seen it all but this one has to take the cake. Are we so wrapped up in ourselves and our own venues that we are willing to jeopardize the park and it's reputation as an ideal location for retirement. What kind of message are we sending to our owners if we cannot work out differences for the betterment of our park. The suit will only serve to widen the gap between the owners and only our property and its values will suffer. We elected this board to handle our situation and now it appears that some of our board cannot even attend meetings. All because they do not agree with some factions. It is a shame that these three senior board members ( PB,LM,MS ) have found fit to dismantle our Board. Besides making this place the pits, no one in their right mind would now run for the board unless you're name is Reta, a lawyer, or a crony of these three. As far as showing up for the meeting, I'm sure these defendants would have rather been there at the meeting than seeking legal counsel. We as a park have taken a big step back because of these three senior directors and their actions.
If I had so many of the Owners I was elected to represent against my actions I would have resigned by now as Don Pelletier brought up in the meeting. Apparently their vendetta is more important to them than the Village welfare.
I doubt seriously that PB, LM, or MS will resign.
The is no reason for McBride, Hansen, or Peterson to resign, the charges in the lawsuit are totally false and unjust. It's unfortunate that these 3 as well as Dodson, Sullivan, and Young have to pay for defense to show that the charges in the suit are unjust.
Never have any of them said they want to be rid of Aramark and never have they said they want to run the park and get paid.
This is a bunch of crap.
I wonder if Don Pelletier had been falsely accused of the actions that McBride, Hansen, and Peterson had if he would resign or fight to keep his honor.
There is nothing factual about anything in the petition that was sent out this summer or in the allegations in the lawsuit.
I guess RP and LM have friends with deep pockets to finance this.

We can thank Reta Priest and LeRoy Mulch for suspending the business of LIV. There is not a Director in their right mind who, if they had been named in a lawsuit would've shown up for the meeting on Saturday without the advise of legal counsel.
So once again LIV hangs in limbo and business cannot be taken care of.
Morris Smith and Don Pelletier shame on you for saying that Sullivan, Dodson, and Young should've been at the meeting. I cannot imagine that if it had been you being named you would've shown up without seeking legal counsel first.

Well the shoe could fit on the GM as well, since he has many residents who don't care for his management skills. Maybe he should resign.
So let me see how this works. You're on a board of directors, and you disagree with some of the opinions/actions of the majority of the other directors. Not a problem-- just bring a lawsuit against all of the directors you disagree with. Then throw out all of the previously voted on items, and carry on as if all is right with the world. As long as there are deep pockets behind you, the minority can still have their way. My wife and I just moved into the village in August, and we cannot believe what we are seeing. To actually bring a lawsuit against your fellow villagers-- how awful! I say get a life and let's move on-- you're wasting our time!!

You nailed it on the head with your analogy of some on the BOD, if you don't like what's going on, just sue. That is SAD.
Please don't judge LIV on Reta Priest and LeRoy Mulch's actions, they are just 2, there are many more wonderful people here.
"New Owners"
Before the election March 2, 2008, LM,PB, & MS went around bad mouthing the 3, calling them all "hotheads".LM got Reta Priest,
Bud Sherry, and Virginia Martin (her to re-run)to run for the Board.They never wanted to get along and work with the 3 from the start. The 3 came up with some good ideas and they were part of the work done on the golf course with the donation money. The people who did not live here or did not go to canidate night voted for these people according to their resumes. Apparently they must have thought these 3 were better canidates than Reta Priest or Bud Sherry. These 2 then got
the petition letter together and sent it out with the ballots. I hope this stunt will fail too when the judge reads how stupid these reasons are for a recall.
Hello, can you please clarify your posting which specifically refers to "Directors Hansen, Peterson, and McBride have been sued and served restraining orders...", but then later mentions "Also sued were Directors Dodson, Young, and President Sullivan." Why the separation of the directors being sued, and the mention of the firts three haviong restraining orders, but no mention of the other three having restraining orders?
Is there a different lawsuit being filed against some but not the others? Or does the restraining order only apply to three but not the others?

To my understanding only those three each received the restraining orders with their individual lawsuit while the other three each received a individual lawsuit only.
This may well bankrupt our Village, perhaps it's time to ask PI to annex us, allow Cowen to add to our resources and dismantle the BOD and fire Aramark. Under Aramark's watch all this has been spiriling downward. Security fiascos, management problems too numerous to detail here,hateful and vindictive actions on the part of all involved. It is disgraceful, embarrassing and destructive. Directors who have a history of involving us in law suits and residents who returned only to cause turmoil should examine their own lives and carefully consider what motivates them to act as they do. The BOD was not designed to fill the empty lives of heartbroken and unempowered individuals. It is time we find a new way to govern and operate our Village. Is it NOT clear to everyone our current design IS NOT working!
The whole point of this lawsuit seems to have been to disable the board to the point that the 3 older members could control the boards actions. Then, Pellitier had the gall to complain for the other 3 for not showing up, knowing his 3 members could control the meeting. If I were Sullivan, Dodson and Young I would continue to miss meeting for the next 3 months or until this useless lawsuit crap is over.

I heard a comment the other day that could apply to our park and the directors targeted...Tough Times never last but Tough people do...So I hope they will hang in there and make our park a better place to be....
It appears to me this is all about power and control. The 3, PB, MS, and LM, will not stop until they have total control of the the BOD, the Park, the newsletter, and the GM.
It is time for the spporters of Dodson, Hansen, McBride, Peterson, and Young to speak up and let everyone know you SUPPORT CHANGE & IMPROVEMENTS OF LIV. Send letters or E mails to the BOD to inform them of the harassment and annoying calls you received from the SGG to change your vote and state the lies and untruths you were told about these people.
Show your support of these, to show that PB, MS, and LM cannot control, intimidate, and harass the people of LIV.
We cannot be silent any longer!

Incorporate the code-of-conduct guidelines into the annual board self-assessment discussion to hold the board accountable for following them. Also, consider some form of individual board member evaluation as part of the board self-assessment and use that information to counsel disruptive members. Educate board members on constructive ways to raise issues, monitor processes, influence the board agenda, and question policies vs. personalities.

Finally, on those rare occasions when nothing seems to work in modifying the disruptive behavior of a board member, ask the individual
to leave the board. This may seem harsh, but remember—the overall effectiveness and efficiency of the board comes first

Too bad Rita Priest is on the other side and fighting for the "evil empire". She knows how to wage a campaign.
Seems like the 'good side" needs people with some spunk who will do more than sit around and let things be done to them.
I hope everyone will educate themselves regarding the number of lawsuits LIV is facing, I have heard #s ranging from 4-9!We will not have $ to sustain our community, maybe someone is paving the way for Aramark to buy us out and finally succeed in owning this previously valuable property.We have never looked so bad physically, old, damaged park models on Sanddollar have not been moved and we are a liability. If the manager has any part in encouraging this lawsuit then we must seriously consider his motives and wonder what commission is available for enabling the takeover of our village. Warning to all involved:DO NOT BE MANIPULATED, QUESTION THE MOTIVES AND FINANCIAL/FAMILIAL CONNECTIONS OF THOSE INVOLVED, TO ARAMARK. You got that right. The "evil empire" has deep pockets and as we all know the $ helps.
The newsletter is biased, what really happens around LIV is not published so people who aren't here think everything is just 'peachy'. There have been incidents where LM didn't include important info in the minutes and MS leaves out info so the Winter Texans don't have a true picture, just what MS wants you to know.
The new BOD members are trying to make things BETTER and PB, LM, and MS are willing to let things stay the same. SAD!

What happened SAT? Call BP or,LM, LD,RP, KD,DP,. They will tell you the truth they will tell all you need to know and after you know what they know. Go ask someone else and after you know what they know, talk about it. Then talk to someone else find out what they know and talk about it.. The truth is becoming much clearer now! Oh yes your on a roll. And after you do this for....lets say 6 months. The truth became so clear that your blinded by lies.
The new board members have not even had a chance to perform. They don't want to take over the park they don't want Aramark out. They need to know where the deadwood is. That's why I voted for them!
They need to know where all the money goes. We need to manage our money better. While the new members asked questions to the old members, the old BOD'S are getting their feelings hurt. If they had nothing to hide.. why are they fighting so hard not to answer. LD has spent our monies like he had a bottomless pit of green back. I don't care how he got alone with anyone or if people liked him or not!. It has now become a fight of personalities.The well being of our future is not on the minds of the old BOD'S.
Those few can not set their differences aside for one meeting ! PB with all her diversions. If these few only knew how silly they look to me. And I will not forget the pain they have caused us all. They have done nothing to make me proud. But I'm sure they are proud of them selves. That's what's wrong That's the truth! Talk about!
I wrote to this blog on the 28th suggesting the Board members Sullivan, Young and Dodson continue to miss any monthly meetings until all nine members are allowed to continue serving. I would amend that by saying no more than one should attend any monthly meeting to remain under a quorum thereby preventing the three old members from taking control of our resort. The President is, in effect, the CEO of our Association, and in the absence of a quorum, can and must make whatever decisions are necessary to keep our village functioning. He can talk to all eight other members and make unilateral decisions on how this village is to operate.
Monthly meeting attendees - This crowd disturbance must stop. I would suggest the President make an opening speech when the meeting starts that any disturbance that interupts the board's business, a recess will be called. He should then tell them on resumption they will move to another location and it will then be a closed meeting with only board members. And do it!!
Meeting attendees - Before the meeting you can talk to anyone you want to. When the meeting begins, only on two occasions can an attendee talk. l. If the President recognizes you, you may speak. 2. If the meeting is not being carried out according to Roberts Rules, you may interrupt and request a "point of order". Otherwise, sit down and shut up.
Board members under duress - I can only imagine the strain this is putting you and your families thru. Please hang in there for our sake. It's very obvious the three oldies want you to give up and let them appoint new directors that will continue to agree with them like the last few years. Having read the lawsuit details, it would seem to me any reasonable judge would dismiss this case.
Severals blog comments have suggested RP get a life. I agree and suggest it be in another state. Surely she has some relatives in another state that would enjoy her company - Probably Not. I can't believe Leroy agreed to be part of this sham. I didn't agree with him very often, but he seemed to be a reasonable person.
Since I don't want to receive any nasty phone calls or be part of another lawsuit, I'll remain anonymous. Just call me "Goober".

You have made very good points, however the BOD President is unable to control the meetings. While he is a nice person and I like him, he simply can't handle the job as President. Maybe it is because he listens to one of the "old guard" on the BOD too often. No need to mention names I believe you can figure it out! Frankly I'm surprised he was named in the suite at all.
I see PB's name is not on the legal papers. Oh someone is bailing out. To late my dear friend. To late. You will abandoned those involve like DS did the new members. I believe DS, that's what lead LIV here.
I believe even you, PB know this has gone to far. If you try real hard you can put a stop to this. We understand you support LD and you have shown that. Its not about liking or disliking the man.
RP will stand alone. LM has sat on the board much to long. Its hard for him to let go. We understand L. It might be nice to just go fishing take your wife on vacation and smile once inwhile.
This entire episode in the life and times of LIV will soon be old news and a stepping stone to the future THINGS TO AVOID.

Now there is a GREAT idea! I'm serious...perhaps someone should suggest that to Reta. Reta, PB, LM & MS against the FOUR NBODs..Dodson should be included since she was elected at the same time. I believe how the "evil empire" handled themselves vs the NBODs would be a real eye opener to a lot of people. Of course the debate host would have to find a way to silence the "cackeling chorus". Tickets could be sold and the $$$ raised put into a fund to repair the streets! LIV SHOULD GET SOMETHING OUT OF ALL THIS MESS.
What ever happened to the election process that is enjoyed by the people of our great country. The board members that have been elected should be left alone to govern as they see fit, after all, these are the people the majoity elected to the board. With a little patience these people can be removed from the board during the next election if the majority of the people do not agree with their performance. The voters of LIV will be able to see the board members voting record and decide for themselves who is doing the best job for LIV. I think all the board members are committed to doing the best job they can for our association. I hope this isn't a personel issue when the people we elected were placed on the board to serve LIV's best interest from a broader perspective.
